By securing a reservation or utilizing our Service, you consent to adhere to these Terms. Should you object to any portion of the terms, you may not use the Service.
2. Service Overview
BlueStoneGarden offers a range of upscale yacht charter services, which includes, but is not limited to:
- Day-long yacht hires
- Evening sea cruises
- Company getaways
- Exclusive gatherings
- Extended charter trips
All provided services are subject to change based on availability and atmospheric conditions. We maintain the right to alter or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you should:
- Be 18 or older
- Provide valid and comprehensive information
- Submit the required advance payment as indicated in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs when payment is received and we issue a written confirmation. We retain the authority to deny service to any person at our discretion.
3.3 Availability
Charter services are dependent on the availability of the vessel and favorable weather. We will strive to accommodate your requested dates and times where possible.
4. Payment Terms
4.1 Pricing
All service costs are stated in € and incorporate any relevant taxes, unless noted otherwise. Prices are subject to adjustment without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost is required during booking
- Balance: Payable 48 hours before the charter sets sail
- Incidental fees (if any): Payable upon the charter's conclusion
4.3 Payment Methods
We accept major credit cards, electronic bank transfers, and certified bank drafts. Our payment processing utilizes secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours’ notice prior to departure: Full refund minus transaction fees
- Between 24 to 72 hours before departure: 50% of the payment will be refunded
- With less than 24 hours’ notice before departure: No refund will be provided
5.2 Weather Cancellations
Should our captain determine weather conditions unsafe, the following options are available:
- Rebook your charter for another available date without any extra charge
- Receive a full reimbursement if rescheduling is impractical
5.3 Mechanical Failures
In case of mechanical failures with the designated yacht, we will attempt to offer an equivalent replacement. If no replacement is accessible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Regulations
Every passenger is required to:
- Adhere to all instructions from the crew
- Use the safety gear provided when instructed
- Inform about any medical conditions affecting their safety
- Stay within the designated areas of the yacht
6.2 Banned Items
The following items are prohibited on board:
- Glassware
- Illegal substances
- Weapons of any kind
- Excessive beverages beyond moderate consumption
- Pets (unless with prior approval)
6.3 Behavior
Travelers must act in a respectful and orderly manner at all times. We reserve the right to terminate the charter prematurely without a refund if passenger behavior endangers safety or hampers the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liabilities to the cost paid for the charter and are not responsible for:
- Personal harm caused by passenger carelessness
- Missing or damaged personal belongings
- Indirect, incidental, or punitive damages
- Delays resulting from weather or situations beyond our control
7.2 Insurance
We maintain comprehensive marine insurance that covers our fleet and operations. Passengers should ensure they have their own travel and personal insurance.
7.3 Risk Acceptance
By choosing to partake in our charter services, you recognize the inherent perils of marine activities and claim responsibility for your safety and welfare.
8. Alterations and Itinerary Adjustments
We reserve the authority to alter travel plans, routes, or itineraries owing to weather concerns, security requirements, or operational demands. Efforts will be made to provide alternatives of comparable quality.
9. Force Majeure
We are exempt from any liability concerning delays, cancellations, or changes brought about by events outside of our control, which include but are not restricted to:
- Extreme weather phenomena
- Natural catastrophes
- Regulatory impositions
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
We handle your private details in accordance with our Privacy Policy. Utilizing our services implies your consent to the data collection and utilization procedures as spelled out in our Privacy Policy.
11. Intellectual Property
